“Just put your house into a trust and avoid inheritance tax!”
If only it were that simple.
Social media platforms are littered with ads suggesting that putting your home into a trust is an easy way to avoid Inheritance Tax. But unfortunately these adverts leave out some very important details.
In many cases, if you give your home away but continue living in it without paying a full market rent, the law may still treat the property as part of your estate for Inheritance Tax purposes. Simply changing the legal ownership doesn’t necessarily change the tax position.
Trusts are valuable legal tools and can be an excellent solution for the right client. However, there is no “one-size-fits-all” trust that allows you to:
🏡 Keep living in your home;
🔑 Keep control of it;
💷 Avoid Inheritance Tax; and
🛡️ Protect it from care fees.
If you see an advert promising all of the above, it’s worth asking a few more questions before signing up. Every family’s circumstances are different, and good estate planning starts with understanding your situation rather than simply selling a product.
