Will the mediator speak to the child or children?

This depends on the child’s age and level of understanding. When parents separate, children can sometimes feel unheard or out of control, which can be confusing and overwhelming.

In some cases, it can be helpful for a mediator to speak with the child through a process called Direct Child Consultation (DCC). This allows the child to share their feelings in a safe, neutral and confidential space with a specially trained mediator.

The mediator will not ask the child to take sides or make decisions, and the child can choose how much of what they share is passed on to the parents.

This approach can give parents valuable insight into their child’s thoughts and needs, helping to shape decisions that are more child focused and supportive for everyone involved.

Yes, mediation is confidential, which encourages open and honest discussion. However, there are three important exceptions to be aware of:

1. Child protection concerns – if there is any suggestion of child abuse, mediation will stop and the relevant authorities will be contacted.
2. Financial disclosure – any financial information shared during mediation is not covered by confidentiality.
3. Legal aid cases – if you or the other party are using legal aid, the Legal Aid Agency may audit the mediation file.

Confidentiality helps create a safe space to discuss sensitive issues, while these exceptions ensure safety, transparency and compliance with legal requirements.
