As the autumn leaves fall, many people begin to reflect on different aspects and changes in their lives, including their personal relationships. For some married couples, this period of reflection can prompt a reassessment of their happiness and long-term compatibility. While many use this time to strengthen their relationship and address ongoing concerns, others may conclude that divorce may be the next step for them.

Our Immigration Department recently secured a successful outcome for a vulnerable client from Paraguay following an asylum and human trafficking claim.

The case highlights the importance of identifying issues that may not be immediately apparent, particularly where a client has experienced trauma or exploitation.

Through careful preparation and the submission of further supporting evidence, the Home Office withdrew its original refusal and indicated that it intended to grant the client leave to remain. This case demonstrates the importance of looking beyond the immediate immigration issue and ensuring all relevant circumstances are properly considered.

The phrase a “gift is a gift” is often used across many platforms about the nature of something that does not change regardless of circumstances.

A gift in most instances is given with love with no “strings attached” and given freely without expectation of receiving anything back such as wedding gifts.

But in the context of relationship breakdowns recollections vary on the true intentions or purpose of those gifts when given during the marriage.

We are now well into the traditional wedding season, where there are newlyweds who discussed the possibility of a pre-nuptial agreement but for a multiple of reasons did not have their intentions formalised before they married.

This does not mean that there is nothing further that can be done, if the intention remains or, if they have decided they would prefer financial certainty if the marriage were to break down.

While prenuptial agreements or “pre nups” are written agreements entered by a couple prior to marriage or civil partnership, couples can enter into a post nuptial agreement after the marriage which serves the same purpose.

Last month, in honour of South Asian Heritage Month, the team at Freemans came together to celebrate the rich contributions of the South Asian community.

Throughout the week, we recognised and honoured both known and emerging South Asian figures in the legal profession through a series of profile posters displayed at our office. We also enjoyed a selection of delicious South Asian snacks, giving everyone the opportunity to learn, celebrate and connect through culture.

At Freemans, we're proud to celebrate the diverse backgrounds, achievements and perspectives that strengthen our profession and our workplace.
