Most of us would name the son or daughter who runs the family business as our executor — and usually that is exactly right.

But a High Court case this summer, Brinner v Brinner, shows the catch. A son was removed as executor, not for doing anything wrong, but because he owned company shares his stepmother thought belonged in his father's estate. He could not fairly investigate himself.

The answer is simple: write down share transfers, keep company records straight, and think about a second executor. More in our latest article.
