What actually is a trust, and could one help your family?

A trust is a legal arrangement where assets are held and managed by people you choose (the trustees) for the benefit of the people you care about (the beneficiaries).

Trusts are not just for the wealthy. Used well, they can protect money for children until they are old enough to handle it, control how and when things are passed on, and help you plan for the future.

They are powerful, and they do need setting up correctly, which is where honest advice matters. We will tell you plainly whether a trust is right for you, or whether a straightforward will already does the job.

Already made a will? Well done, you are ahead of most people. Now, when did you last check it?

A will is not a "sort it once and forget it" document. Life moves on, and an out of date will can cause just as many problems as having no will at all.

It is worth reviewing after any big change:

- Marriage or a civil partnership (this can even cancel an existing will)
- A new baby or grandchild
- Buying a home or coming into money
- A change in family circumstances
- Or simply a change of heart

A review is quick and inexpensive, and it buys real peace of mind that your will still says what you actually want.

When is the perfect time to protect your family? Honestly, it is sooner than most people think.

Lots of us put making a will off, because it feels like a job for "later in life". The truth is simpler: a will matters the moment there are people or things you care about. It is never too early to plan, and it is very rarely too late.

A professionally written will makes sure your wishes are followed and the people you love are looked after, rather than leaving it to chance.

If it has been on your to-do list for a while, we make it easy: home visits across Yorkshire, and online appointments anywhere in England and Wales.

Why do I need a Lasting Power of Attorney (LPA)?

Here is the difference that catches most people out. A will decides what happens after you die. An LPA protects you while you are still alive.

If an accident or illness ever left you unable to make your own decisions, an LPA lets someone you trust step in. There are two types: one for your health and care, and one for your property and finances.

Without one, your loved ones may have to apply to the Court of Protection to act for you, which is slow, costly and stressful, at exactly the moment your family least needs it.

An LPA is one of the most reassuring things you can put in place. We explain both types in plain English and can set them up for you.

Why do I need a will? Because without one, the law decides, not you.

If you die without a will in England and Wales, strict rules called the rules of intestacy take over. They may not reflect your wishes at all. Unmarried partners and stepchildren can be left with nothing, no matter how long you were together.

A will puts you back in control. It sets out who inherits, who would look after your children, and who sorts everything out for you. It is one of the clearest, kindest things you can do for the people you love.

Want to see exactly who would inherit if you had no will? We have written a plain-English guide.
