What Happens When you Die?

In this situation, this is what happened:

The husband dies, and the wife had no idea about the HMO or the licensing.

There was a licence; it was automatically revoked 3 months after the husband died, and no one did anything.

A simple tenant complaint triggered this discovery.

The council was imposing was to impose a Financial Penalty.

Luckily, the related parties sought professional advice rather than incriminating themselves.

Great mediation and, eventually, caution was settled as the best solution based on the actions taken in mitigation.

Knowing what happens when you die is essential for those you leave behind.

Invalid HMO Licences are being issued on a continuous basis and the councils cannot even work it out when it is spelled out for them.

Fixing it is an impossibility for many as they would have to concede they are wrong and even though they are breaking the law.

Some software cannot do what it needs to do to correct the issues.

Software is badly designed in many cases and needs the input of those who know what the problems are and can fix them. These are bugs, Horizon was allegedly a bug.

Unfortunately, they will have to open the kimono and that will reveal even more issues they would prefer were not known.

Postmaster and the Post Office is only the tip of the scandals to come.

Your licence may not be valid and they cannot enforce.

oh crikey!

One wonders why the landlord has come running seeking advice.

1. 1 x couple and a child

2. 1 x couple and a child

Total occupants = 5

Households = 2

This is a HMO being formed.

The agent does not like the answer.

The agent calls the Council and misinterprets it response.

This was after telling me I am wrong he sent the email that says:

Dear Des,

I hope you are well.

Thank you for taking the time to review this case, unfortunately your information is completely incorrect.

After speaking with ###XX City Council directly, they have in fact confirmed that this move in is fully allowed to happen with no restrictions in place.

Two couples, although four people are classed as two tenants/households.

The restriction only applies if there are three or more unrelated households or tenants, as the children are only aged 5 and 6, this also does not apply to them.

Our phone calls are recorded and on file, the landlord has also been advised.

It is lovely to be considered wrong by an agent and the LHA if it did in fact says the above.

The property is vacant the tenancy has not commenced (thanks God) and the landlord is on his way to change the locks before they sneak the occupants in.

Better to lose some money than have multiple fines.

Having spoken to the Council myself and being told that I understand the matter better than they do, it does make me wonder if the information was conveyed correctly.

HMO Tip 7️⃣: Learn how to screen for cooperative tenants!

Continuing screening HMO tenants before you grant them a viewing, the most important thing now you've done most of the questions is to continue your screening by sending them an application form and that application form will have similar questions for them to reconfirm in writing and to sign consent for you to reference.

You get all of that in advance of the viewing, now you know you have somebody who's cooperative. This really makes a difference.
