A reminder for landlords: tenancy deposits must be protected properly and on time.

Under section 213 of the Housing Act 2004, any tenancy deposit taken as security must be protected in a government-approved scheme within 30 days of receipt. This is not something to leave until later and getting it wrong can have serious consequences.

Failure to comply can expose landlords to financial penalties and may also affect the ability to serve notice in the future. In practice, we often see deposit issues become a problem when a landlord is already trying to deal with arrears or regain possession.

Deposit compliance is one of those key early steps that should never be overlooked. The right documents, the right process, and the right timing all matter.

What happens if a tenant refuses to leave after the notice period?

Many landlords assume that once notice expires, the tenancy simply ends. In reality, if the tenant stays put, you still need to follow the correct legal possession process.

A valid Section 8 notice does not by itself remove a tenant from the property. If they do not leave, the next step is usually a court claim for possession. In many cases, there will then be a hearing, followed by a possession order, and if needed, enforcement through the proper channels.

What landlords must not do is just as important. Changing locks, removing belongings, or pressuring a tenant to leave can amount to illegal eviction and lead to serious consequences.

The safest approach is to act promptly, stay compliant, and take legal advice early. A mistake at the start can cause major delays later.

Important changes are coming into effect this month for SDLT submissions.

HMRC has introduced a new regulatory framework that will affect those dealing with tax matters on behalf of clients, including Stamp Duty Land Tax submissions. Under the proposed changes, professionals interacting with HMRC may need to register as tax advisers and meet new minimum standards.

For the property sector, this is significant. SDLT returns are now expected to fall within the scope of the new regime, even where wider tax advice is not being given.
