The process for completing Lasting Power of Attorney documentation looks pretty simple.

You can complete your LPA documentation online, but the process isn’t always straightforward. We worked with a family who had applied for LPAs themselves, only to have them rejected three times. When they finally received the approved version, they realised some of the details were wrong. In particular, there were misspellings of names and incorrect dates of birth. That’s when we got involved.

Getting important details wrong can mean your representatives can’t use the LPA when you need them to.

In the past year, we’ve heard of a legal case where a carer was prosecuted after she used her status as an attorney to steal money from a client. In another, a law firm partner is being investigated as it’s alleged he pressured clients to grant him power of attorney, mismanaged their finances and failed to keep proper records.



Both highlight the importance of including legally binding instructions. For example, you can ensure an accountant or other finance professional reviews your records to ensure everything’s in order. My husband recently used AI , hoping it would plan a useful travel itinerary and provide a visual of the route. He is an engineer by trade so detail is his thing- this is what it came up with!!

AI can do some great things, but it isn’t always correct and more and more people are using it to draft their wills or to check their DIY drafts.

Families can be complicated at the best of times, but more and more of us are now part of a blended family.

We might have children from previous relationships or have become a step-parent. When you make your will, it’s always worth considering your blended family and whether you want to provide for them in your will. When did you last review your will?

Making a will is one of those jobs that most of us put off for as long as we can. Once it’s done, at least you can sit back and forget about it, right? Sorry, but no. Your will is part of your overall financial planning and should be reviewed regularly.

Reviewing your will annually lets you check whether it reflects any changes are needed and when done in conjunction with us or you usual estate planner also in light of any changes in law.
