If you cannot remember what your Will says, that tells you something.

A Will or LPA should reflect your circumstances and the decisions you want recorded now.

Over time, names, addresses, assets, relationships and your own wishes can change.

I think many families underestimate how quickly those details can shift.

An LPA may also need checking to make sure the arrangements you intended were properly completed.

You do not need to assume something is wrong.

Start by finding your documents and reading through them carefully.

One of my clients once thought living together was enough.

Then they realised how difficult things can become when an unmarried partner dies without a Will.

I think this is one of the most important distinctions for couples to understand.

Living together for years does not automatically give your partner the same inheritance rights as a spouse or civil partner.

Without a valid Will, intestacy rules determine who inherits, which may not reflect what you wanted.

That can create extra uncertainty at an already difficult time.

A Will lets you record your choices clearly and make your intentions easier for your family to understand.

If something in your Will needs changing, I would not recommend simply writing on the original document or assuming every update is handled in exactly the same way.

The right approach depends on what has changed.

Some substantial changes may mean preparing a new Will.

Some more limited changes may be dealt with differently, for example through a Codicil or, for certain wishes, a Memorandum of Wishes.

That is why I think the sensible first step is to explain what you want to change before deciding how to change it.

A small change in your life does not always mean the same thing legally as a major one.

If there is something in your existing Will you want to change, start by finding out which route is appropriate.

Getting married can change more than your surname or your household.

It can also affect an existing Will.

If you already have a Will and then marry, I would encourage you not to assume the old document simply carries on doing exactly what you intended.

Marriage can affect its validity, so it is sensible to review your arrangements when that part of your life changes.

You may not need to rethink everything.

But you do need to know whether what you already have still reflects your current circumstances.

Others may prefer much more of the estate-administration process to be handled for them.

Choosing an attorney is an important part of making an LPA, but it is not the only part I want clients to think about.

Your own wishes matter too.

An LPA can be tailored around your circumstances, including instructions and preferences that help explain how you would like certain matters handled.

That can make the conversation more personal than simply choosing a name and signing a document.

When I speak with a family, I want to understand what matters to them first.

From there, we can look at how those wishes may fit into the planning.

Living together for years does not automatically mean your partner will inherit in the way you expect.

I think this is an important distinction for unmarried couples to understand.

If you die without a valid Will, intestacy rules decide who inherits.

An unmarried partner does not automatically inherit under those rules in the same way as a spouse or civil partner.

That is why I encourage couples to think beyond what feels obvious within the family and consider what has actually been recorded.

A Will gives you the opportunity to make those choices clear rather than relying on assumptions.
