Siddick Gokhool successfully won the appeal against conviction and sentence for driving a car with tinted front windows at Snaresbrook Crown Court. R V NUTHAY.
Defendant was stopped by police in his Porsche while driving with 95% tinted windows when the required limit is 30%. He was prosecuted under Section 40A of RTA driving a vehicle to cause danger of injury to a person. He was fined £550, cost of £620 and 3 points on his licence. The decision was overturned as the argument was that the court could not be sure that it was causing danger to a person.
