Bhogal Partners recently helped a family dealing with the aftermath of a home repossession, where the impact went far beyond property and finance. A close family member living at the home had severe disabilities, complex care needs and relied heavily on the stability, routine and familiarity of that environment. After the eviction, we moved quickly to raise those welfare concerns with the lender and agents, protect belongings left inside, seek access, press for the matter to be put on hold, and gather financial evidence from the wider family. That work helped move the matter towards full redemption of the mortgage, return of possession and release of the keys, while keeping the family’s circumstances front and centre throughout.

Bhogal Partners has secured a High Court order setting aside seven trust deeds affecting four family properties. The deeds had been prepared by an unregulated wills and trusts business as part of inheritance tax planning, and were signed without proper advice about ownership, trustees’ duties or substantial tax consequences. Unfortunately, subsequent and Solicitors advice was also flawed. This left the client with a potential loss of around 1 million. The case demonstrates the serious risks of purchasing complex estate planning products from providers who are not professionally regulated or appropriately insured. Acting for the Settlor, Bhogal Partners successfully obtained relief in the Property, Trusts and Probate List. The Court set aside all seven deeds.
