This client had been attempting to get his wife to the UK for 2 years. After getting wrong advice from others and several rejections, he came to us on a low, desperate for help. Unfortunately his 2 year old daughter has cancer and had to leave Yemen when she was just a few months old for treatment in the UK, leaving behind the mother who was a non-British national.

The father had been singlehandedly caring for his daughter throughout her treatment. The mother was unable to pass the English test due to being in depression and anxiety due to the situation and the father had little funds for the hefty immigration fees.

We first applied for a fee waiver for the application which was granted in 4 weeks after we requested a fast track application. Then we applied for an entry clearance application via spouse and human rights based on exceptional circumstances. We emailed various home office departments for a fast track application and the visa was granted in just 6 days after biometrics!! And the partner was granted a visa based on the 5 year route. 👏

Application Process
It is crucial to thoroughly plan before submitting your Child Student Visa application in order to maximise your chances of success.

Here is where you will have to start with:

Choose the most appropriate educational institution for your child and make an application to secure an admission
As an admission process, your child should receive unconditional offer and Confirmation of Acceptance number from the school
Book a TB test from the recognised centre by UKVI

Individuals can apply to come to the UK in this category if they can show that they:

are a Commonwealth citizen;
are aged 17 or over;
can work and you plan to work in the UK; and
can adequately support and accommodate yourself and your dependants without help from public funds
In addition, the applicants must also show that at least 1 of their grandparents was born:

in the UK (including the Channel Islands and the Isle of Man); or
before 31 March 1922 in what is now the Republic of Ireland; or
on a British-registered ship or aircraft
Applicants can claim ancestry if your relationship to the relevant grandparent is in the legitimate or illegitimate line.

As UK Ancestry visa holder, the individuals are permitted to work, undertake study courses and bring in family members to join them in the UK.

However, the applicant cannot switch into this visa if they are already in the UK on another visa. The applicants are also not allowed to get public funds.

Dependents of Points Based system visa holders
Family members of migrants who are in the UK on a points based visas meaning – UK Skilled Worker visa would be allowed to enter the UK as dependents.

A ‘dependent’ is any of the following:

husband, wife or partner
child under 18
child over 18 if they’re currently in the UK as a dependant

Dependants applying from outside the UK
If the dependants meet all the relevant requirement of the dependant visa, then they would be required to apply online. After the online application form is submitted, the applicant seeking entry clearance as a dependant would go to the Visa Facilitation Service Center to submit all the supporting documents. At the VFS Center, the applicant would be asked to provide his biometric information (i.e. fingerprint and digital photograph).

Dependants applying in the UK
In certain cases, the dependants can apply to extend or switch their visas to stay with the migrant if they’re already in the UK. They should apply using the dependant application form.

They can apply at the same time as the primary applicant or at a later date by post, or in person at a premium service centre in the UK.

While applying for a dependent visa it is not possible for the applicant to ‘switch’ the visa from within the UK, this means that Family members can’t apply in the UK as a dependant if they hold a visitor visa and have entered the country on a visitor visa. The applicants will be required to return to their home country to make a fresh application for seeking entry as a dependent.

The visa is granted for the same duration as the visa of the main applicant.

For dependent children, all arrangements for children’s care and accommodation in the United Kingdom must comply with relevant United Kingdom legislation and regulations.

For all dependent visa applications, it is necessary to show that the applicant and the sponsor will be able to support themselves without any recourse to public funds. This is also called as the maintenance funds requirement.

ILR – Victim of Domestic violence
UK Immigration rules allow for the ILR to be granted to certain people who have limited leave to enter or remain, or have an extension of stay, in the UK as the spouse, unmarried partner, registered civil partner or same-sex partner of a British citizen or person present and settled in the UK. This is an opportunity to applicants whose relationships have genuinely broken down, due to domestic violence, during their probationary period of leave, to be granted an indefinite leave to remain (ILR).

Domestic violence is classed as any incident of threatening behaviour, violence or abuse (psychological, physical, sexual, financial or emotional) between adults who are or have been intimate partners or family members, regardless of gender or sexuality. An adult is someone who is 18 years or over. The legal definition of injury is when any harm is done to a person by the acts or omissions of another.

Knowledge of language and life in UK test is not required for victims of domestic violence. Applicants are exempt from fee payments if they meet these conditions.

Overview – UK Graduate visa
For individuals who are already in the UK on a UK Student visa, can further apply for a UK Graduate visa. This post-study work visa allows the applicant to stay in the UK for at least 2 years after successfully completing a study course in the UK.

What are the eligibility criteria for a UK Graduate visa?
The applicant has to be in the UK.
The applicant is currently on a UK Student visa or UK Tier 4 (General) Student visa.
The applicant has studied a UK Bachelor’s Degree, Post Graduate Degree or another eligible course on their UK Student visa or UK Tier 4 (General) Student visa.
The applicant’s education provider (for example, a university or college) has informed the UK Home Office about their successful course completion.
What are the documents required to apply for a UK Graduate visa?
The documents required to apply for a UK Graduate visa are listed below:

A valid passport or another travel document that proves the identity and nationality of the applicant.
Biometric residence permit (BRP), if the applicant was given one when they applied for a UK Student visa or a UK Tier 4 (General) Student visa.

What is Administrative Review?
When your application for the visa is refused you can ask for the decision on your visa application to be reviewed only if you are told to do so in the Refusal application letter. This is known as the Administrative review.

If you are in the UK and:
Your application was refused, then you must apply for an administrative review within 14 days of getting the decision.

Your refusal letter will tell you how to apply.

Your application was granted but there are issues with the conditions of your visa, you must email the Home Office within 14 days of getting your biometric residence permit.

You have been detained, You must apply within 7 days.

If you are outside the UK, you may apply for an Administrative review if you:

Are currently outside the UK

Have applied from outside the UK

Do not have a right of appeal due to the circumstances of your visa category.

(Exceptions: Short Term Student and Visitor Visas cannot avail the administrative Review)

You must apply for an Administrative Review within 28 days of getting the decision. The decision will be checked for the error you point out. You will usually receive the result of the administrative review within 28 days. There is no provision for the second review (unless the result of the first review found new reasons why you were refused).

What are certificates of sponsorship?
A Certificate of Sponsorship (CoS) is an electronic document generated on the Sponsor Management System (SMS) after a licence is granted. In order to sponsor a migrant worker, the company must first request a CoS from the Home Office through the SMS. Once this is granted, the company will need to assign it to the migrant worker they intend to sponsor to generate a unique reference number for the candidate to submit during their visa application.

Under new sponsor licence rules, the Home Office has rebranded its previous two types of CoS depending on the immigration status of the migrant worker:

Defined CoS

These certificates are required for those who are based outside the UK and making an entry clearance application as a Skilled Worker.

Once you have identified a person you want to sponsor, you can apply for this on the SMS, and the Home Office will normally process this within 1 working day unless additional information is required. This is judged on a case-by-case basis.

Previously, sponsors were required to submit their request for a restricted CoS (now defined CoS) by the 5th of each month to receive a decision by the 11th of the same month.

The overall cap on the number of defined CoS the Home Office can grant annually has also now been abolished.

Note: Those who are in the UK as visitors will not be able to apply for a Skilled Worker visa within the UK and will need to return to their country of residence for submission. Therefore, they will require a defined CoS.

Undefined CoS

A sponsor can request multiple undefined CoS before their annual allocation expires if they foresee a need to extend the leave of an existing employee or have identified someone they wish to sponsor who requires an undefined CoS (for example, someone “switching” visa category). If a sponsor is able to justify the need for the request, then the CoS allocation will be granted

The processing time for a request to increase your allocation is 18 weeks. However, a priority service is available at an additional cost of ÂŁ200.

What are the key personnel roles required for an organisation to obtain a sponsor licence?

You will be required to appoint people within your business to manage your sponsorship licence. These people will need to be declared when applying for the licence. The roles are:

- authorising officer – a senior and competent person responsible for the actions of staff and representatives who use the SMS
- key contact – your main point of contact with UK Visas and Immigration (UKVI)
