We provide legal and HR advice to individual employer's across the UK who rely on self-directed support and employ PAs and care workers to support independent living. We also advise self-employed care workers who work in the sector. Our legal helpline is available to policy holders of the Mark Bates Ltd Home Employment and Personal Assistant insurance policies.

As we’re coming to close the festive season of 2025, we cannot help but look forward to what is going to be a very busy 2026! Legal Update

The Employment Appeal Tribunal have handed down judgment in this case where a claimant PA challenged the identity of their employer. On appeal, the EAT have confirmed that Northamptonshire County Council were not the employer.

Employment Rights Bill - snapshot
** SSP changes and consultations opened today **

The Employment Rights Bill proposes two key changes to the current provisions on statutory sick pay (SSP):

1. Remove the three waiting days currently required before an individual can claim SSP. This means that SSP will be payable from the first day of sickness.

2. To remove the lower earnings threshold meaning more people will qualify to be paid SSP.

At present the lower earnings threshold is Β£123 per week which must be earned in order for an employee to qualify for SSP at a flat rate of Β£116.75 whilst unfit for work. The Bill provides for some lower earners, including those earning below the Lower Earnings Limit, their rate of Statutory Sick Pay will be calculated as a percentage of their earnings instead of the flat weekly rate.

The government have opened consultations today to determine what percentage of wages should be payable and welcome views from:

* Employers and employer/business representative organisations

* Members of the public and employee

* Interested Trade Unions, stakeholders and representative organisations
