Recent succession law changes: what do they mean for cohabitants making claims on death?

🏡 Many cohabiting couples are surprised to learn that surviving partners do not automatically inherit from an estate where there is no Will. Recent changes to Scotland’s succession laws have added a new dimension to that discussion.

While cohabitants still do not have the same legal position as spouses or civil partners, the reforms may affect the benchmark courts use when considering certain claims on intestacy.

📋 The changes are a useful reminder that relying on assumptions can leave families exposed to uncertainty at an already difficult time.

Putting appropriate arrangements in place during your lifetime remains one of the most effective ways to protect those closest to you. Read more in Roisin Cooper’s latest article: https://ow.ly/OBo550Z7WeT

Umbrella companies in STEM: ready for reform? ⚙️🧾

Umbrella companies continue to play a significant role in the STEM contracting landscape, but growing regulatory attention suggests change is on the horizon.

As this gathers momentum, businesses engaging contractors through umbrella arrangements should be aware of the potential legal and compliance implications, particularly around:

🔎 Worker classification and employment status
🔎 Tax compliance and payroll practices
🔎 Supply chain and intermediary risk
🔎 Increased regulatory scrutiny in STEM sectors

For employers, the key takeaway is that reliance on umbrella structures is no longer a “set and forget” solution. Greater due diligence and proactive risk management may be required as the regulatory environment evolves.

How is your marriage? Practical family law advice for corporate lawyers 💼

👨‍👩‍👧‍👦 Family law issues can surface unexpectedly in corporate transactions, particularly where ownership structures, personal wealth and succession planning overlap.

For corporate lawyers, understanding how marriage, cohabitation and separation may affect shares, business assets or future claims can help identify risks earlier and support more rounded client advice.

🔎 In some cases, the legal position surrounding personal relationships may have direct implications for negotiations, valuations and long-term planning.

Bringing family law considerations into wider strategic discussions can help avoid complications further down the line. Read more in Beverley Addison’s latest article: https://bto.co.uk/blog/how-is-your-marriage-practical-family-law-advice-for-corporate-lawyers/

When a settlement isn’t the end: lessons from the Channel 5 dispute

⚖️📺 The Channel 5 dispute is a useful reminder that resolving an employment claim does not always resolve the wider issues around reputation, accountability and public narrative.

Settlement agreements often involve no admission of liability, but the surrounding facts, public statements and ongoing commentary can still carry legal and commercial consequences.

🔎 For employers, the case underlines the importance of clear settlement terms, careful handling of confidentiality obligations and a robust approach to workplace culture issues before disputes escalate.

It also shows why harassment, discrimination and whistleblowing allegations require more than a reactive legal response once proceedings are underway. Read more in Kimberley Green’s latest article: https://bto.co.uk/blog/when-a-settlement-isnt-the-end-lessons-from-the-channel-5-dispute/

Franco Manca, 225 jobs and the cost of assuming redundancy is straightforward ⚠️🍕

When a restructuring involves site closures, the commercial reason may be clear but the employment law process still needs careful handling.

For employers, particularly SMEs, the risk often sits in the detail: who is placed in the selection pool, how consultation is approached, whether alternative roles are explored, and how decisions are documented.

🧭 Redundancy planning requires more than reaching a defensible outcome - employers also need a clear record of the process, reasoning and steps taken along the way.

The use of artificial intelligence agents and compliance with consumer law in the UK 🤖⚖️

AI agents are increasingly being used to engage with customers, streamline services, and support decision-making across businesses.

With that shift comes greater scrutiny. Consumer protection rules still apply, including around transparency, fairness, and accountability in automated interactions.

💡 Organisations adopting AI should consider how these tools operate in practice, and whether existing processes meet regulatory expectations.

Understanding the legal framework now can help avoid issues as use expands. Read more in Erin Findlay's latest article here: https://bto.co.uk/blog/the-use-of-artificial-intelligence-agents-and-compliance-with-consumer-law-in-the-uk/

New competition laws give more clarity for technology licensing 💡📄

For businesses licensing patents, know-how, software or other IP rights, competition law can shape what restrictions are enforceable and where the risk points sit.

The new UK and EU frameworks preserve the familiar “safe harbour” approach, while adding useful clarity around areas such as data licensing, market share thresholds and emerging technologies.

🔍 A key practical point: technology licensing agreements should still be checked carefully against the updated guidance, especially where exclusivity, non-compete provisions or field-of-use restrictions are involved.

Mental health: turning awareness into action in the workplace 🧠🌱

Awareness can start the conversation, but workplace mental health depends on what happens next.

For employers, that means looking beyond policies on paper and asking whether day-to-day working practices genuinely support people under pressure.

🛠️ Clear processes, trained managers and open workplace cultures can all help identify concerns earlier and respond more effectively. This is also about legal risk, leadership and building healthier, more resilient teams.
