Do you always need probate? And do you really need a will? 🤔

Not necessarily and yes!

Probate is the legal authority needed to deal with someone’s estate after they die. But not every estate needs a grant of probate. For example, some jointly owned assets pass automatically to the surviving owner, and some banks or other organisations may release smaller amounts without probate. The rules can depend on the assets and the organisation involved.

But having a will is still important.

A will lets you decide who should benefit from your money, property and possessions, and who should deal with your estate and also who should look after any minor children. Without a will, the law decides who inherits under the intestacy rules — which may not be what you would have wanted.

So, even if you think “my estate is simple and I won’t need probate”, having a properly prepared and valid will can still give you and your family valuable certainty and peace of mind.

A warning to anyone who is currently going through the probate process - the court fee is set to increase from £300 to £526 on 13th July! So make sure you get your applications submitted in good time.
