Many people believe having a Will means they’re covered but a Will only protects your family after you pass away.

What Is the Court of Protection and Why You Want to Avoid It 💭

Most people have never heard of the Court of Protection until it affects someone they love. It’s the court that steps in when a person loses the ability to make decisions for themselves and doesn’t have a Lasting Power of Attorney (LPA) in place.

Here’s what really happens: if someone becomes unable to manage their finances or make healthcare decisions, and there’s no LPA, their family must apply to the Court of Protection. The Court then decides who can act for them, by appointing a Deputy.

It sounds like a safety net, yet for families it can be a slow, stressful, and expensive process.

⏳ The application process often takes 6–12 months.
💰 It involves legal and court fees that can add up to thousands.
📑 Deputies must follow strict rules and report regularly to the Court.
