Legal Update: Proposals to extend the 5-year settlement route have now been put forward.

The UK Government has published a new consultation paper, "A Fairer Pathway to Settlement," which proposes fundamental changes to how legal migrants obtain Indefinite Leave to Remain (ILR).

The key proposal is a shift from the current 5-year route to a default 10-year "Earned Settlement" route. Most significantly, the Government has proposed that these changes could apply retrospectively to individuals currently in the UK who have not yet obtained settlement.

We have reviewed Command Paper 1448 and prepared a detailed legal analysis and a legal opinion of the "Time Adjustment Model," the proposed income thresholds and the specific impact on Health and Care visa holders.
