👉 It can set out what happens to the family home, pensions and business interests.
👉 You can decide who is responsible for debts and whether either of you will receive spousal support.
👉 It can protect inheritance or future gifts so they stay with the intended person or children.
👉 Some agreements also cover life insurance or estate planning.

Remember, anything relating to child custody or support isn’t typically enforceable in a postnup, family courts always prioritise the children’s best interests.

In England and Wales, postnuptial agreements are not automatically legally binding but they can be very persuasive in court if certain conditions are met:

Where complexity arises:
