Buying a property with a partner or even a friend? 🏡
But one of the biggest decisions you will make is how you own the property together.

When buying jointly, there are two main options:

• Joint tenants
You both own the whole property equally. If one person passes away, their share automatically goes to the other owner. This cannot be left in a will, although the arrangement can be changed later.

• Tenants in common
You each own a defined share, which could be equal or different. This means you can leave your share to someone else in your will.

It is also a smart move to record your financial agreement in a trust deed, especially if contributions are not equal.

So what do they mean?

T marks on a title plan show who is responsible for maintaining boundaries like fences or walls.

• A “T” pointing into your property usually means it is your responsibility
• An “H” mark indicates a shared boundary, so maintenance is typically shared between neighbours

In conveyancing, there is an important distinction between physical and legal boundaries and understanding it can save you from future disputes.

Physical boundary:
This is what you can see. Fences, walls, hedges or even a row of trees that appear to divide properties.

Legal boundary:
This is the exact line recorded in title deeds and transfer documents. It is a precise and often invisible boundary.

So why do they differ?

• Fences can be moved, replaced or deteriorate over time
• A neighbour may install a fence slightly inside their own boundary
• Some boundaries were never clearly marked on the ground

This means what you see is not always what you legally own.
