Sometimes, the greatest threat to a family's legacy doesn't come from strangers. It comes from disagreements over what loved ones leave behind.

One real-life inheritance dispute in the UK demonstrates how costly those disagreements can become.

THE STORY: THREE SIBLINGS, ONE FAMILY HOME

Robert Chung, 62, had lived in his parents' family home in South Woodford, London, for decades.

After his mother, Irene Chung, died in 2016 without leaving a will, a dispute arose over her estate, valued at approximately £600,000.

Robert claimed that his parents had promised him the family home because he had returned to care for them. He argued that he had made personal and career sacrifices based on those promises.

His siblings disputed his claims, and the disagreement eventually reached court.

Because their mother had died without a will, the applicable intestacy rules governed the distribution of her estate.

Robert pursued a legal claim seeking ownership of the entire property. However, the judge found that he had not established his claim that his parents had promised him the house.

His claim was dismissed, and the court ordered him to leave the property. He was also ordered to pay substantial costs and compensation relating to his continued occupation of the home.

A £434,000 mistake. No will. And a family left dealing with an estate dispute.

When British lawyer Bartholomew Gold died in December 2020, aged just 43, he had not made a will.

He left behind his wife, Phikul Harte, and a teenage son from his previous marriage.

Following the sale of his property, £434,134 from the sale of the house and its contents was mistakenly paid into the account of his former wife, Marsha Gomez.

The dispute ended up in court. A judge ordered Gomez to repay £447,427, including interest, after the money was found to belong to Gold's estate.

The case highlights two important issues: Gold died without a will, and a substantial sum belonging to his estate was mistakenly paid to his former wife.

Although the report does not establish that the absence of a will caused the payment error, the situation demonstrates why clear estate planning and proper estate administration matter.
