The primary applicant fees are as follows:

The Education Legislation Amendment (Integrity and Other Measures) 2025 Bill establishes a clear pathway for government and the sector to work together to ensure a high-quality education and student experience for all students – domestic and international.

Key Updates

1. Refined Definitions

Education agent commissions now include all benefits (monetary or non-monetary) given to agents in connection with international recruitment.

This ensures clearer accountability and transparency in agent–provider relationships.

2. Department of Education Powers

Can collect and share data on agents and commissions.

May request information on commissions paid to agents.

Expanded authority to examine cross-ownership arrangements under new “fit and proper provider” requirements.

3. Purpose of the Changes

Responds to concerns about rising agent commissions and diverse payment types.

Helps providers choose ethical, high-quality agents.

Supports stronger sector integrity and protects students.

4. Provider Restrictions

VET providers must enrol and teach domestic students for two years before enrolling international students (except government-funded TAFE institutions).

Providers inactive for 12 consecutive months in delivering courses to overseas students risk cancellation of registration.

Government can cancel courses if concerns arise about quality or alignment with Australia’s skills needs.
