🏘️ Living in a Spanish urbanisation can be wonderful — but community disputes can arise, and knowing your rights makes all the difference.

Robert and Susan came to us after a long-running dispute with their community of owners over serious maintenance issues in their development near La Manga. The communal pool had been out of service for over a year, maintenance fees were being used without transparency, and the management company was unresponsive.

They felt powerless and frustrated. They did not know where to turn.

Our team stepped in, reviewed the community statutes and the Ley de Propiedad Horizontal (the law governing Spanish communities of owners), and made a formal legal intervention on their behalf. Within two months, an extraordinary general meeting had been convened, the management company was replaced, and a proper maintenance plan was in place.

Robert and Susan are now active members of their new community committee — and enjoying the pool again. 😊

📝 What actually happens at the Notary (Notaría) in Spain — and why it matters for your property purchase.

If you are buying property in Spain, you will hear a lot about the Notario. The Spanish notarial system works very differently to the UK conveyancing process, and knowing what to expect in advance makes the whole experience much smoother.

Here is a quick guide:

✔️ The Notario is a public official — they verify the legal validity of the transaction but do NOT act for you personally
✔️ Both buyer and seller (or their legal representatives via Power of Attorney) must be present at the signing
✔️ The Notario reads the escritura (deed) in full — this can take 30 minutes or more
✔️ You pay the full purchase price at the Notary — usually via bank cheque or transfer
✔️ After signing, you must register the property in your name at the Land Registry

Critically — having your own solicitor present (or reviewing documents beforehand) is not the same as having the Notario on your side. They are neutral. You need your own legal representation. 😊
