Why Do We Need a New Mindset in the Legal Profession?
In an era where economic and commercial changes are accelerating worldwide—driven by the pervasive influence of capitalism—the role of the lawyer can no longer be confined to memorizing statutes and reciting legal provisions. Instead, the lawyer’s true function lies in transforming legal texts into practical solutions that serve individuals and corporations, while ensuring a balance between rights and obligations.
From my own experience working on international arbitration cases and drafting cross-border contracts, I have become fully convinced that a successful lawyer is not merely one who knows the law, but one who knows how to employ it as a tool for risk management and opportunity creation for the benefit of the client.
A well-drafted contract is not just a piece of paper; it is a guarantee of stability and clarity between the parties. Without doubt, it is also the arena in which we ensure the security, protection, and preservation of the rights of our client—whether an individual or a corporation.
Likewise, arbitration is not merely a dispute resolution mechanism; it is a means of preserving and protecting commercial relationships from collapse. After all, reputation is the foremost capital of any trader, as our professors of commercial law often reminded us. Arbitration also spares us from the pitfalls of excessive rigidity, delay, and lack of specialization—at a time when business leaders are far more focused on creating and seizing opportunities than on lingering over disputes.
For these reasons, I firmly believe that the future of legal practice lies in combining two essential elements: the lawyer’s ability to master the interpretation of both domestic and international legal texts, and the practical adaptability to keep pace with business environments. Moreover, every lawyer must develop a well-crafted strategy for managing disputes before they escalate.
