Business continuity is not merely an operational concern. It is a matter of legal responsibility.

On World Backup Day, attention is often directed towards technical safeguards and data recovery systems. From a legal perspective, however, the issue is more fundamental.

The inability to access or restore critical data may give rise to direct legal consequences. Contractual obligations may not be performed, regulatory requirements may be breached and exposure to claims may arise.
In such circumstances, the relevant question is not whether systems failed, but whether appropriate safeguards were in place.
Companies are expected to implement and maintain systems that ensure the integrity, availability and recoverability of their data. This expectation is reflected not only in applicable regulatory frameworks, but also in contractual commitments and broader principles of risk management.

The issue therefore extends beyond IT.

It is a matter of governance.

Boards and senior management bear responsibility for ensuring that business continuity measures are appropriately designed, implemented and periodically tested. The absence of such oversight may give rise to liability, particularly where foreseeable risks have not been adequately identified and addressed.
