Summary vs. Indictable: Why the "Label" Matters

Not all criminal charges are treated the same in Ontario. Whether your charge is "Summary" (less serious) or "Indictable" (more serious) changes your trial options, your potential jail time, and even your ability to travel.

Most people don't realize that the majority of charges are actually Hybrid, meaning the Crown gets to choose how to prosecute you.

Swipe the slides for a breakdown of how the Crown makes this choice.

You can contact us regarding your case and its unique circumstances.

A Separation Agreement is a crucial document that outlines your rights and responsibilities during separation. To ensure its validity and enforceability:

✅ Ensure it's in writing, signed, and witnessed
✅ Provide full financial disclosure
✅ Seek Independent Legal Advice (ILA) for both parties

Remember, even after divorce, the agreement remains enforceable unless a court sets it aside. Protect your future by understanding your rights.

Dual agency is legal in Ontario, but only when it is fully disclosed and supported by written consent from both parties before any offer is presented.

In the case Partners Realty Ltd. v. Morrow, an agent lost nearly 18,000 dollars in commission because the dual agency was never disclosed in writing.

If you are buying or selling property in Ontario, always clarify whether your agent represents both sides. Written disclosure protects your rights, ensures transparency, and prevents disputes.

For realtors: missing this step can result in the loss of commission and potential disciplinary action.

Many people assume their spouse or children will naturally inherit their estate. Under Ontario law, this is not always the case. Intestate succession follows strict rules under the Succession Law Reform Act, and the outcome can surprise families.

Watch the reel for a full breakdown of this concept.

Intestacy can lead to conflict, unexpected outcomes, and delays. A properly drafted will protects your wishes, your family, and your estate.

Co-owning property is common in Ontario, but the legal structure you choose affects your rights, taxes, estate planning, and even creditor exposure.

🔸️Joint tenancy brings survivorship but can be severed unilaterally.
🔸️Tenancy-in-common allows flexible shares, but each owner can force a sale under the Partition Act.

A detailed co-ownership agreement is essential to define contributions, decision-making, occupancy, repairs, exit rules, and dispute resolution. Trust terms inside the agreement are not shown on the title, so documentation must be precise.

If you are considering co-ownership, get proper legal guidance before finalizing anything.

Ontario’s court structure is more complex than many assume. Each level has different powers, limits, and remedies. Misfiling can delay a case, restrict available relief, or lead to cost consequences.

The OCJ handles summary criminal matters, child protection, and parenting/support issues, but cannot issue divorce or property orders. The SCJ has full civil, criminal, and family jurisdiction, including injunctions and declaratory relief. Small Claims Court handles disputes up to $35,000 but cannot grant equitable remedies.

Appeal routes can be equally complex. Some decisions go directly to the Court of Appeal, while others require leave to the Divisional Court. The Federal Court handles only federal judicial reviews, not provincial family or civil matters.

If you want to choose the right forum from the start, our team can help you avoid delays and jurisdictional issues.

Writ of Mandamus in Canada (2025 Update)

When your immigration file feels stuck, a writ of mandamus can compel IRCC to act—but only if strict legal conditions are met.

It’s an extraordinary remedy, not a fast-track. Courts will only grant it when:

✅ There’s a clear legal duty to act
✅ You’ve met all your obligations
✅ There’s no other remedy available
✅ The delay is unreasonable
✅ And fairness supports the request

Important: The court doesn’t decide your application—it simply orders IRCC to make a decision.

If you’re considering mandamus, ensure your file is complete, your demand letter is documented, and your case meets the legal threshold.

🎥 Watch our full YouTube video to learn about the process, success rates, and real case examples.
