A Form 3 is a legal tool that allows person to be detained for up to 14 days in a psychiatric facility in Ontario. On a Form 3, a person is an "involuntary patient" and they are not allowed to leave the hospital. Once the Form 3 expires, a physician can decide to issue another form to keep the person at the hospital for longer.

Changes to the FEDERAL (not provincial) portion of the New Housing GST Rebate rules - it is now EASIER to qualify for the rebate worth up to $6,300 to homebuyers.



Changes to the FEDERAL (not provincial) portion of the New Housing GST Rebate rules - it is now EASIER to qualify for the rebate worth up to $6,300.

BEFORE: if two or more individuals buy a home together, all must buy the home for use as their (or a relation's) primary place of residence in order to qualify for the rebate - otherwise none of them qualifies.

WHY IT WAS PROBLEMATIC: purchasers sometimes add friends or distant relatives as partial owners on title to facilitate financing. For example, Husband and Wife, the newlyweds, buy their first condo (primary residence) and the Wife's Uncle agrees to be 1% owner on title and co-signs on the mortgage. If the Uncle does not plan to live in the condo, none of the purchasers (Husband, Wife or Uncle) are entitled to the rebate.

BUDGET 2021 PROPOSAL: the condition that each purchaser must acquire the home for use as their (or a relation's) primary place of residence is removed. Instead, the GST New Housing Rebate would be available as long as the new home is acquired for use as the primary place of residence of any one of the purchasers or a relation of any one of the purchasers.

The Federal portion of the New Housing GST Rebate entitles homebuyers to recover 36% of the GST (or the federal component of the HST) paid on the purchase of a new home priced up to $350,000. The rebate is phased out for new homes priced between $350,000 and $450,000. There is no rebate for new homes priced at $450,000 or more.

✧ If you happened to be a director of an Ontario corporation and later ceased to be a director or just thinking of resignation, don’t forget to do it appropriately.

✧ Directors of corporations can be held personally liable for the unpaid GST/HST or payroll remittances of their corporations. This liability is restricted to two years after the director last ceased to be a director of the relevant corporation.

✧ The two -year limitation period starts to run only when a director has successfully resigned. The Ontario legislation requires a director to deliver a written resignation to the corporation in order to resign. It is important that the resignation is signed and dated. It is worth keeping both a copy of the written resignation and proof that it was sent to the Corporation.

✧ Some additional requirements imposed on a first director of an Ontario corporation. When an Ontario corporation is incorporated, the Articles of Incorporation list its first directors. The first director cannot validly resign unless the first meeting of shareholders has taken place or unless at the time the resignation a successor director has been elected or appointed.

✧ Do not underestimate the importance of paperwork as a significant amount of liability may attach if a resignation is not recorded appropriately.

✶It happened again. The phone calls with requests for help to get away from the purchase of a pre-construction condo. The construction of new buildings takes some time. People’s plans change and they want to re-assign their rights under the agreement.

✶The problem is that the assignment clause has to be incorporated in the agreement in order to expect it to happen. If there is no such clause, it’s highly unlikely that the builder will allow the assignment.

✶Builders sometime do not include the assignment clause in the agreement unless expressly requested by the purchaser. As a result, some purchasers in the same building might be allowed to assign and the others don’t.

✶Moreover, even if the assignment clause exists, the wording of the clause is imperative to understand. The wording varies greatly. Sometime assignment is allowed with the requirement that the new purchase price in the assignment remains the same as the original one. Such kind of wording may diminish the whole idea of the assignment as the most common purpose of the assignment is that the original purchaser would like to get profit from assigning the agreement to a new purchaser.

✶Pre-constructions purchase and sale agreements are lengthy and complex, but in many cases, they contain all the necessary information you need to know about your future property. It is always worth reading it within the 10-day cooling-off period as it will help you to clarify important issues and avoid unexpected disappointing surprises when the agreement becomes firm on your side.
