The recent decision in Lowe Estate v. Nova Scotia (Department of Opportunities and Social Development), 2026 NSCA 61, is a significant one. In finding for the appellant, a person living in his tent, and who had sought assistance on the basis that it met the requirements of being ‘accommodation’, the Nova Scotia Court of Appeal provided important guidance on the application of the reasonableness standard and the interpretation of section 49 of the Employment Support and Income Assistance Regulations, with implications for future requests and eligibility for Enhanced Rate assistance.

Que se passe-t-il lorsque les droits linguistiques sont violés à maintes reprises ?

Dans une affaire faisant jurisprudence en matière de droits linguistiques au Nouveau-Brunswick, la Cour du Banc du Roi a accordé des dommages-intérêts à un citoyen dont le droit de recevoir des services en français avait été violé à plusieurs reprises par un établissement de santé publique.

La décision rendue dans l’affaire Ouellet c Réseau de santé Horizon réaffirme un principe essentiel: les droits protégés par la Charte canadienne des droits et libertés entraînent des conséquences concrètes lorsqu’ils sont violés. Elle rappelle également que l’obligation de communiquer et de fournir des services dans les deux langues officielles s’étend à l’ensemble de la population, et pas seulement aux personnes bénéficiant directement de services publics.

What happens when language rights are repeatedly ignored?

In a precedent-setting language rights case in New Brunswick, the Court of King's Bench awarded damages to a citizen whose right to receive services in French was repeatedly violated by a public health institution.

The decision in Ouellet v. Horizon Health Network reinforces a critical principle: rights protected by the Canadian Charter of Rights and Freedoms carry real consequences when breached. It also serves as an important reminder that the duty to communicate and provide services in both official languages extends to all members of the public - not only those receiving direct government services.

Almost 10 years after writing about what it means to “look professional” as a young q***r “almost-lawyer”, Jaime Burnet, lawyer in our Halifax office, considers a deeper question: can you be a lawyer and be your full q***r self at work?

In this new article, Jaime shares a candid, personal perspective on the reality of being q***r in the workplace today in the context of a growing anti-trans, anti-q***r global movement. She writes that we should be pushing for the ability of people from all equity-deserving groups to safely be their full selves in their workplaces, schools, and communities.

As we look ahead to the 2026 Prisme Conference in Halifax this July, “Unity in Law: Shaping the Future of 2SLGBTQ+ Rights”, we’re glad to see these conversations continuing, and more people sharing their perspectives and experiences.
