By complying with relevant legislation, both employers and their staff members can ensure that their hiring processes, dismissal processes, and their workplace as a whole, are fair for every individual. We are specialists trained in HR Law and we are the first contact point when an employee feels they are being treated unfairly within their workplace; whether it is unsafe practices or harassment f

rom other employees etc. We are here for both the employers and employees. Once the employee contacts us, we start a file and document all the relevant information while it is fresh in their minds. This information is presented to a review board who consist of members of the community including (but not limited to) doctors, lawyers, government officials, HRDC, and the Human Rights Commission. Based on the relevant data presented, the board decides whether this case would win in court or if it is the fault of the employee. If the board doesn't think it should continue the file is immediately closed. If the board does think it should continue, it is determined whether the employee wants to continue the process and accept legal representation. A minimal offer is presented to the employer that stops all allegations and court proceedings, if accepted. However, if the offer is not accepted, the file is transferred to the law office and legal proceedings commence.

Today "Crowe Soberman" is blacklisted on our national database for discrimination. The victim was told to not to take a sick day and work extra hours until busy season was over. As soon as business slowed down, they let the employee know that they are looking for a younger crowd and do not want employees from outside Ontario. No comment from the CEO on what is going to be done to correct this issue going forward. The victim signed a waiver in exchange for a cash settlement instead of going to court.

WHAT WE LEARNED AND MOVING ON!

2022 was a busy year and we learned a lot:
• We learned that “MNP” will unjustly dismiss employees when they are sick with Covid.
• We learned that “TD” doesn’t want to hire someone above the age of 40.
• We learned “FBC” sends out fake tests in order to get malware into applicants’ computers.
• We learned “Kelly Services” wasn’t concerned about 2 individuals posing as recruiters to obtain personal information (eg. Social insurance number, signature, credit information, birthdate, etc.)

We don’t get much good news about employers. Let’s start 2023 with some good news – Post a something positive about an employer you are working for.
