বাংলাদেশে মুসলিম ব্যক্তিগত আইন নিয়ে একটি প্রচলিত ভুল ধারণা: স্ত্রীর বিবাহবিচ্ছেদ শুরু করার অধিকার নেই।

আছে। একজন মুসলিম স্ত্রী চারটি স্বীকৃত পথে বিবাহ বিচ্ছেদ করতে পারেন — তালাক-ই-তাফউইজ (কাবিননামায় ক্ষমতা দেওয়া থাকলে), খুলা (স্বামীর সম্মতিতে), মুবারাত (উভয়ের সম্মতিতে), অথবা মুসলিম বিবাহ-বিচ্ছেদ আইন ১৯৩৯ ও মুসলিম পারিবারিক আইন অধ্যাদেশ ১৯৬১-এর অধীনে পারিবারিক আদালতে।

একটি প্রচলিত — ও ক্ষতিকর — ভুল ধারণাও আছে: স্ত্রী বিচ্ছেদ শুরু করলে তার মোহর বাজেয়াপ্ত হয়ে যায়। হয় না। মোহর একটি স্বাধীন আইনি অধিকার — বিয়েতে সৃষ্ট, বিচ্ছেদে বিলুপ্ত হয় না।

চেক ডিজঅনার মামলায় (Section 138, Negotiable Instruments Act, 1881) আপনি আসামি? আপনাকে যদি কেউ পরামর্শ দিয়ে থাকে যে নিজের নির্দোষিতা প্রমাণের জন্য আপনাকে আসলে কিছুই করতে হবে না — শুধু আদালতে দাঁড়িয়ে অস্বীকার করলেই বাদীপক্ষ এমনিতেই হেরে যাবে — তবে জেনে রাখুন, সাজা প্রায় নিশ্চিত।

এটি সাধারণ ফৌজদারি মামলার মতো নয়।

Section 118(a) এর অধীনে আদালত আইনগতভাবেই ধরে নেন যে চেকটি বৈধ বিনিময়ের (consideration) বিপরীতে দেওয়া হয়েছিল। বাদীপক্ষ শুধু চেক ও স্বাক্ষর প্রমাণ করলেই হয়; বাকিটা আইন নিজেই করে দেয়। এরপর প্রমাণের ভার আসামির উপর এসে পড়ে — এবং সেই ভার পূরণ করতে হয় বিশ্বাসযোগ্য সাক্ষ্য দিয়ে, "preponderance of probabilities" মান অনুসারে। শুধু মুখের অস্বীকার এই ভার পূরণ করে না।

অনেক ট্রায়াল কোর্ট খালাসই উচ্চ আদালতে আপিল আবেদন করায় উল্টে যায় — কারণ ট্রায়াল কোর্ট প্রায়ই Section 118 না মেনে শুধু "criminal standard" এর কথা ধরে খালাস দেয়, যা আইনগতভাবে সঠিক নয়।

Bangladesh's courts have been increasingly clear: a writ petition is not just a last resort — it is a legitimate first step when a constitutional right or a statutory duty is directly at stake.

What this means in practice: you don't always have to exhaust every tribunal and lower court before the High Court will hear you. Where the issue is purely legal, and the facts are not in dispute, the High Court can — and does — act.

This is an important protection that many people don't know they have.

Many people confuse an Artha Rin suit with a regular civil money suit. They're very different.

Artha Rin Adalat (Money Loan Court) was created specifically for bank and financial institution debt recovery. It operates under its own statute — the Artha Rin Adalat Ain 2003 — with faster procedures and strict timelines.

If a bank is suing you — or you're trying to recover a bank loan — this is the court you're dealing with. And the rules are different from ordinary civil courts.

Most legal problems in Bangladesh get worse the longer they wait.
