Transfer of Property Act, 1881 recognizes six types of mortgages:

1. Simple Mortgage: No possession transfer; personal liability; property sold via court if defaulted.

2. Mortgage by Conditional Sale: Appears as a sale; becomes absolute on default or void on repayment; enforced by foreclosure.

3. Usufructuary Mortgage: Possession transferred; mortgagee enjoys rents/profits; no personal liability.

4. English Mortgage: Full ownership transferred with a promise to repay on a fixed date; includes personal liability.

5. Equitable Mortgage: Created by depositing title deeds in notified towns; no written agreement needed.

6. Anomalous Mortgage: Custom or mixed-type mortgage not fitting other categories; governed by contract.

Lifting the Corporate Veil

Normally, a company is treated as a separate legal person from its owners. But sometimes, courts "lift the corporate veil" to hold individuals personally liable—especially when the company is used to commit fraud or avoid legal responsibilities.

A famous case is Salomon v. Salomon & Co. Ltd (1897), which established the principle of separate legal identity. However, courts have made exceptions. For example, in Gilford Motor Co Ltd v. Horne (1933), the veil was lifted because the company was used to hide a breach of contract.

These exceptions protect justice and prevent the misuse of company status.

In July this year, the then Prime Minister resigned and left the country in the face of a mass uprising by students and the public, and the 12th National Parliament was dissolved by the President.

In order to take immediate measures in such a situation, His Excellency the President has enacted and promulgated several Ordinances since August this year under the powers conferred by Article 93 (1) of the Constitution of the People's Republic of Bangladesh.
