Protect your Intellectual Property in Bangladesh

Bangladesh is a member of the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement, which sets minimum standards for intellectual property (IP) protection. Bangladesh has been granted a transition period to comply with TRIPS, and has also been granted a waiver on patenting pharmaceuticals.

According to the decision of the Council for Trade-Related Aspects of Intellectual Property Rights (TRIPS), as long as the period of exemption from patent protection of medicinal products and agro-chemical products remains in force, such products shall remain outside the scope of patent protection.

Transition period

Bangladesh is a least developed country (LDC) and has a transition period to comply with TRIPS until 2034. This transition period does not apply to national treatment, most favored nation, and right of priority Bangladesh has also been granted a waiver on patenting pharmaceuticals and Ago-Chemical products until 2033.

New patent law Bangladesh has enacted the Bangladesh Patents Act, 2022, to make patent provisions more responsive to consumers and innovators. The act states that an invention can be patented if it is novel, innovative, and applicable in industry.

Other IP-related treaties

Bangladesh has signed several other international treaties and conventions related to IP, including the Berne Convention for the Protection of Literary and Artistic Works

Infringement of IP rights can be a breach of civil or criminal law, depending on the type of IP involved, jurisdiction, and the nature of the action.
