Is property settlement 50/50 in family law?

There is no specific mathematical formula used in dividing property between separating parties. In determining the division of property, the court will consider a variety of factors including the financial contributions before, during and after the relationship and the non-financial contributions made as homemaker and parent. The court will also consider the future needs of each of the parties. Every family is unique and advice about property settlement should be tailored based on each families circumstances.

Can I move interstate with my child without the other parent’s consent?

While there are no laws that prevent you from moving interstate with your child, if parenting arrangements have been decided in court or by agreement, relocating without the other parent’s consent may breach your court order and trigger urgent recovery proceedings.

It’s always a good idea to ask for concise legal advice about your options when planning to move with a child.
