Rob Jaleel Ballais was admitted as a solicitor to the Supreme Court of Queensland in September 2016. Since admission, Rob has practiced primarily in Family Law & Domestic Violence and has developed a keen interest in the property side of Family Law Matters. Rob prides himself on chasing and obtaining positive outcomes for his clients. He is a people person, Townsville local of over 20 years and understands the emotional drive of his clients and skilfully aims to identify their ultimate end goal. Jodie van-Vegchel was admitted to practice in December 2023 and even though she is junior by title she is not junior by experience. Prior to admission Jodie already had 12 years of experience working for well-known and respected firms across Far North Queensland where she gained extensive knowledge in Family law; Domestic violence; Criminal law; Child safety and Youth Justice; Good behaviour orders; and Consumer law. Jodie was also a Court Officer for Youth Justice and would regularly attend court to advocate for young people in the justice system and passionately advocates for Young People when caught in the system. Jodie’s extensive experience in the Domestic Violence field has seen her passionately advocate for anyone caught up in the complex world of Family & Domestic Violence and although she will advocate for anyone who needs it, she has developed a keen passion for assisting men in this area of law. She has experience dealing with men of all age groups and backgrounds including Veterans and serving military personnel. Jodie recognises the difficulties and unique circumstances that men often face during family separation and will strive to get the best outcome for her clients. Why smaller boutique Law Firms may suit you better?

If you have a legal issue in your life and you're considering asking for legal advice, the search for a lawyer or law firm can often be overwhelming. It can be tempting to just call the first google result at the top of the page or go with a bigger firm because the old saying "bigger is better" comes to mind.

But......this is not always the case! Here are some reasons why retaining the services of a smaller or boutique firm may better suit your needs:

1) Personal Attention
One of the benefits of a smaller law firm is that clients may get more personal attention and more access to speak directly to their lawyer. At bigger firms, work is usually originated by partners and then projects are completed by associates or other staff. As a result, there may not be much communication between the clients and the people performing work on their behalf. This can lead to inefficiencies in communication, feeling of "what and who am I paying to do this" and can also mean that there is not much of a personal connection between clients and the lawyer.

At Benchmark Law Services, you will always have direct access to the Lawyer handling your matter and it is them who will perform work on behalf of a client and always have the direct instructions and first hand knowledge of the legal issues on foot.

2) Fee Flexibility
Another one of the benefits of a smaller law firm is that they have more flexibility in fee arrangements than larger law firms. Lawyers in larger firms usually charge clients by the hour at rates dependent on the person doing the work. This can sometimes put lawyers and clients at odds with each other and create billing anxiety for the clients.

However, smaller firms can often propose fee arrangements that may be more comfortable to clients. This may include flat fee arrangements, fee caps, contingency fee arrangements, and other agreements about fees. Such alternative fee arrangements can ensure that the interests of Lawyer and client are more aligned and that a client is capable of financing a given representation.

3) Efficiency
It is often the case that smaller law firm are typically more efficient at handling certain matters than bigger firms. The lawyer being the one who will undertake most tasks the matter requires which can include client intake, legal research, legal drafting and correspondence, and other projects that are needed to fulfill a client’s goals. By having one person review all of the information related to a representation, it is less likely that details will fall through the cracks and the matter will be less likely to be miscommunicated or mistakes made. In addition, if one person handles a matter on behalf of a client, that lawyer can build relationships with adversaries and others, which can help promote a client’s interests. It is usually best to keep the number working on a matter low so there is no breakdown in communications and smaller law firms can be more efficient by ensuring that one person or a small group is tasked with helping a client.

4) Customer Service
Smaller law firms are generally able to provide better customer service to their clients than larger firms. Lawyers who work at smaller firms are more likely to be stakeholders of a firm. As a result, they have a greater interest in the success of a firm and therefore accordingly, small firm lawyers are generally more willing to go the extra mile for clients to make things as easy as possible for them. This includes traveling to clients to deliver papers, communicating and meeting with clients at hours that are more convenient for them, and simply take the time to make sure the client is happy with how their matter is progressing. The more direct and personal connection clients have with lawyers at smaller firms means clients receive better customer service at smaller firms.

5) Accessibility in times of change or crisis
Lawyers working for smaller firms generally have the capacity to be available at the drop of a hat should a matter suddenly go south, an arrest occurs or another parties actions change the matters legal landscape. Have you been charged with a criminal offence or served with Police Protection Notice for Domestic Violence?

DO NOT SPEAK TO POLICE OR AGREE TO AN INTERVIEW WITHOUT SEEKING LEGAL ADVICE!

In Qld, if you’ve been detained for questioning, arrested, or police attend your location in regard to a domestic violence complaint, you have a right to silence.

You are required to identify yourself but after stating your name and addess, you should state ‘I have nothing to say’ and then seek legal advice. These rules also apply if police want to question you after you’ve been charged with an indictable offence or attending a call out at your location regarding a complaint.

Talking to Police, particularly during a call out after a fight with an intimate partner or family member will not do you any favours. Police are trained to get answers from you that may adversely affect you or accidently incriminate you. Despite you thinking that you are doing the right thing by co-operating, often in the 'heat' of the moment without proper consideration, people tend to say things that can and will be used against them to make a complaint or charges stick.

If you have been pulled aside by Police so they can ask you questions, it is in your best interest to not say anything at all and make it clear you wish to seek legal advice before answering anything. Despite their calm and charming demeanor, Police like to make you feel like they are your friend, and you need to remember that Police are not there to help you or be your friend.

It is important to remember that you should remain calm, remain silent and even if arrested and taken to a watch house, you should remain silent until you can speak to a lawyer.
