There’s been a lot of commentary recently about Testamentary Trusts following the Federal Budget announcements.

And understandably, many people are now asking: “Are Testamentary Trusts still worth it?”

The short answer? Absolutely.

Because whilst tax planning has always been one benefit of a Testamentary Trust, it has never been the only benefit - and for many families, it’s not even the main reason they choose one.

These structures help protect inheritances for:
• young children,
• vulnerable beneficiaries,
• blended families,
• business owners,
• and future generations.

They can help safeguard inheritances from relationship breakdowns, bankruptcy risks, financial immaturity and unintended sideways disinheritance.

Most importantly, they only exist because somebody has died.

This isn’t just a conversation about tax.

It’s a conversation about how families protect loved ones after they’re gone.

I’ve shared some key information below to help explain what we currently know, what remains uncertain, and why Testamentary Trusts still remain an incredibly powerful estate planning tool.

A widow trying to raise children is not a tax scheme!

This week I joined Estate Planning lawyers across Australia in writing to local MPs about the proposed taxation changes to Testamentary Discretionary Trusts.

Because this conversation matters.

In practice, these trusts are not primarily used by wealthy people trying to “game the system”. They are used by everyday families trying to protect vulnerable loved ones after death.

A widow trying to raise children is not a tax scheme.

Neither is:
• a nine-year-old child who has lost their father,
• a grandparent raising grandchildren,
• or a disabled beneficiary needing long-term protection and support.

Testamentary Trusts only exist because somebody has died. For many families, they provide protection from financial exploitation, relationship breakdowns, bankruptcy risks and financial immaturity.

The thing that most people get wrong about the proposed budget 30% tax on testamentary discretionary trusts? The practical outcome is the opposite of what the policy intended.

The wealthy will have a tax neutral outcome but our most vulnerable will have to pay a tax penalty.

The reason most people use a testamentary discretionary trust is not tax minimisation, but for much needed asset protection.

Under the proposed tax, any beneficiary earning less than $45,000 of income from other sources who needs the protection of the trust for their inheritance will be paying a penalty.

The asset protection benefits are so great that wealthy people will still use testamentary discretionary trusts, especially when the tax outcome is neutral.
In a world where everyday Australians rely on their inheritance to get into the housing market, it hardly seems fair.
