Probate is important because it provides legal certainty. It confirms a Will is valid and is the last will of the deceased, appoints the executor, and provides assurance that the estate is being handled correctly.

Without probate, banks, government agencies, share registries and other institutions may not release assets. Probate protects the estate, the executor, and the beneficiaries.

A Grant of Probate takes time. There are a number of steps involved before an application can be filed in the Supreme Court Registry.

Once the application is filed you then have to wait for the court to grant the application which may take 4-12 weeks depending on the court's capacity.

The process of applying for probate can be lengthy.

In Queensland, we are required to advertise notice of an intention to apply for a grant of probate in the Queensland Law Reporter, serve a copy of the notice on the Public Trustee, wait a period of time before filing the application in the Supreme Court Registry and then wait for the Registrar to issue the grant of probate.

This process can take anywhere from 8 weeks plus depending on court processing times and busy periods.

It's important to start the process as soon as you can if a grant of probate is required in the administration of the estate.
