We've all bought a dud. But what can you do about it? Well, if your dud has a major problem - maybe its unsafe or doesn't do what it should, maybe wouldn't have bought the thing if only you'd known the problem - then you could be entitled to a refund or replacement. For duds that can be fixed, you might only be allowed a repair. Whether you're buying or selling, it pays to know your rights.

Should your whole health history – medications, allergies, x-ray results, pathology etc - be stored by the Commonwealth online? Government says ‘yes’, we should all have a “My Health Record”. If you care about your privacy, read on! Under new gun-to-the-head style rules, general practices who don’t create enough records will cease to be eligible for crucial government incentive payments. So what can you do? (1) You are allowed to tell your general practice not to upload information and your direction must be obeyed (of course, this means your My Health Record will be incomplete and helps explain why doctors remain sceptical about relying on it); and (2) You can restrict access to your My Health Record. If you don’t, any healthcare provider who treats you (and who is registered with the My Health Record system) will be able to view your My Health Record, even if that healthcare provider is not your regular treating doctor. Good luck!

It’s the sensible step that will make every visit to the doctor a whole lot easier.

In a blow for borrowers, the High Court has ruled today that late payment fees charged by ANZ were not penalties (so the customer was obliged to pay them). The customer had argued it ought not have to pay, saying it was unjust, unfair, unconscionable (etc) for the bank to charge fees that exceeded the amount necessary to return the bank to the position it would have enjoyed if payment had been made on time. The ruling (which is rather complex) gives savvy businesses an opportunity to review - and possibly raise - the late fees and other charges they impose for breaches of contract.

Hidden camera recordings have hit the headlines again and I've been asked whether we have a right to privacy in Australia. Well, not a universal right, no. We have national privacy laws but they affect only some businesses. We have State laws but they vary. Be careful before you start covert surveillance.
