A drug driving charge isn’t always about being impaired. 🚗 In Victoria, you could face different charges depending on whether a drug was detected, you were impaired, you were driving with alcohol and drugs present, or you refused a required test. ⚖️

Charges can include:
👉 Driving while impaired by a drug
👉 Drug present in your system while driving
👉 Drug and alcohol offences
👉 Drug detected within three hours of driving
👉 Refusing an oral fluid, blood, urine, or impairment test

Cyberbullying-related offences can include:
⚠️ Menacing or harassing communications: Up to 5 years’ imprisonment
⚠️ Threats to kill: Up to 10 years; threats of serious harm: Up to 7 years
⚠️ Non-consensual intimate images and deepfakes: Up to 6–7 years
⚠️ Doxxing: Up to 6–7 years, and stalking in Victoria: Up to 10 years
⚠️ Unauthorised computer access, data modification, and communication interference can also carry serious penalties

A breath test refusal isn’t simply a roadside “no.” 🚨

Under Victorian law, failing to properly comply with testing requirements can itself become a criminal offence, with consequences that may be more serious than you expect. ⚖️

Here’s what’s at stake:
✔ First offence: 12 penalty units and a mandatory 2-year licence disqualification
✔ Second offence: 120 penalty units or 12 months’ imprisonment and a 4-year disqualification
✔ Subsequent offence: 180 penalty units or 18 months’ imprisonment and a 4-year disqualification

Refusal charges are dealt with in court, and depending on the circumstances, issues around how the requirement was made, what was actually refused, and whether a recognised defence applies can matter. 🔍
