In disability services, supporting autonomy is essential.
But legally, choice does not replace responsibility.

The real risk isn’t the decision itself —
it’s how that decision is assessed, documented, and managed.

When risk is predictable and not properly addressed,
liability doesn’t disappear… it shifts back to the provider.

This is where many organisations get caught off guard.

Because what matters is not the intention —
it’s whether your actions would be considered reasonable under scrutiny.

Duty of care and dignity of risk must always be carefully balanced in disability services.

Too much emphasis on duty of care can lead to restrictive practices that limit a participant’s independence.
But too much dignity of risk can expose providers to something equally serious — negligence.

Legally, negligence occurs when there is a breach of duty of care. In simple terms, this happens when someone responsible for providing care fails to do so, and that failure results in harm.

Understanding this balance is critical for organisations supporting vulnerable participants under the NDIS.
