This week is Scams Awareness Week.

A timely reminder that IP right holders and business operators are frequently the subject of scam attempts. These can include fake registration services, renewal scams and fake publication scams.

🛑 STOP: Don't pay unexpected third party "invoices". Scammers often use 'official' sounding names, legal jargon and convincing templates to appear legitimate. They can create a false sense of urgency, threat, impending loss to pressure you into paying quickly.
👀 CHECK: Know your IP portfolio. Know your renewal dates. Check with a trusted professional adviser or contact IP Australia.
🛡 PROTECT: If you think you've paid a scammer, contact your bank immediately, and seek advice from a IP professional.

If you have filed a trade mark application, or operate a business, chances are you'll receive a trade mark scam in the mail or by email. Here are some tips on to watch out for, and what you can do if you receive one.

ASIC has cancelled the registered agent status of another unscrupulous operator, "Registry Australia Pty Ltd".

The cancellation follows the earlier removal of "Registration" for breaches of ASIC's registered agent terms.

Both operators were accused of misuse of public ASIC registry data to send misleading communications and renewal 'invoices' to business name holders and companies.

We strongly recommend that businesses carefully review any unexpected request for payment. If in doubt, contact ASIC or a trusted professional for further advice.

ASIC Registration and Renewal Fees should only be paid via official ASIC channels or through a known and trusted service provider (such as your accountant or lawyer).

⚠🚨 ACSC has released a Critical Alert for website owners. The Alert details large-scale exploitation campaigns actively targeting website content management system ( ) platforms.

Affected CMS include and among others.

If your website operates on these platforms, it is recommended that you urgently review the Alert, consult with IT/developer experts, and take remedial action as appropriate.

The Australian Signals Directorate’s Australian Cyber Security Centre (ASD’s ACSC) is tracking a large-scale exploitation campaign targeting various vulnerabilities in web content management systems (CMS) globally, including in Australia.

Another day, another false and misleading "renewal" notice from "Registration".

This notice claims the business name is "due to be renewed by 10 September 2026". The actual official renewal date is 1 month later.

🛑 BEWARE of unethical third party suppliers offering Business Name renewal, Annual Company Review, Domain Name renewal and Trade Mark renewal or other 'registration' services. Often these will come at an inflated cost far exceeding the official government fee. For Business Name Renewals and Company Annual Review fees, pay ASIC directly or use your existing trusted professional adviser.

📰 From 1 July 2026, professional services providers (including lawyers) will be regulated under the AML-CTF regime.

The link below provides further information for our clients on the incoming changes and how this affects provision of 'designated services' under the new regulation.

Critical changes include requirements to:
- collect and verify KYC information about clients and other stakeholders as part of Customer Due Diligence (CDD)
- assess AML-CTF risks when engaging and conducting transactions

🛒🍏 The Federal Court of Australia has ruled in favour of the ACCC against Coles.

The supermarket giant was found to have engaged in misleading and deceptive conduct in respect of the discounts advertised in 13 "Down Down" promotions.

Zip Co has lost a long-running trade mark battle against Firstmac in the High Court of Australia over various ZIP trade marks.

The key issue was determining whether Zip Co could rely upon the defence of honest concurrent use, upon which the Appeal was dismissed.
