A little more about the person behind the emails 👋

I am Nadya, Principal Lawyer and Co-Founder of Respect Wills & Estates.

But I am also a mum, a wife, a daughter and someone who has experienced loss.

I lost my dad when I was a child, and although I did not understand it at the time, that experience has shaped me in ways I am still discovering.

Maybe that is why I have always believed that Wills and estate planning are about so much more than documents.

They are about people. Families. Relationships. The things that are sometimes difficult to talk about.

My hope is that when someone sits down with me, they feel comfortable enough to have those conversations — honestly and openly.

So, I thought it was about time I properly introduced myself. 🤍

Does the 2026–27 Budget affect your testamentary trust?

We have been asked this question a lot since Budget night. Here is what you need to know right now.

The Government has proposed a 30% minimum tax on discretionary trusts from 1 July 2028. The good news for most of our clients is that testamentary trusts are proposed to be exempt — provided they are established for genuine testamentary purposes and income comes from assets of the deceased estate.

One of a few important things to watch.

If assets unrelated to the deceased estate were injected into the trust after Budget night — 7:30pm AEST on 12 May 2026 — income from those assets may be caught by the minimum tax under the proposal.

It is also important to note: this is a consultation paper only. These proposals have not received Government approval and are not yet law. Submissions close 31 July 2026.

We are monitoring this closely and will keep you updated as the legislation develops.
