Psychological assessments and reports for court proceedings. What are they and why are they valuable?

They provide insight into the psychological and cognitive competence of an individual.

This exposes any personal factors which may have contributed to the criminal offending.

As shown on the image, a number of implications can result from a psychological report in court.

The benefits? A more therapeutic and treatment approach/outcome may be prioritised, rather than solely punishment.

What a way to wrap up this week!

This client faced many allegations related to burglary and theft charges. One significant issue with the evidence was the fact it did not adequately identify our client as the alleged offender.

The outcome for the alleged co-accused is proof of what could have happened, had our client plead guilty, and had our office not challenged the prosecution’s case.

Some of our days in court move quickly. Remand matters in particular can be unpredictable; they certainly keep us on our toes.

In this case, the client was arrested in the morning and released later that afternoon.

This timeline shows the importance of acting quickly following an arrest. The client exercised their right to obtain legal advice before the prosecution took its next course of action.

Being advised to plead guilty doesn't always mean it's the right choice.

In this matter, our client initially received advice to plead guilty to a 'serious indictable offence'. After reviewing the prosecution's materials, we formed a different view and advised our client to plead not guilty.

A guilty plea may be appropriate in some matters; however, it requires a thorough assessment of the evidence and all available legal options. Sometimes, it can be easier to recommend an early guilty plea than to rigorously challenge the prosecution's case.

This matter highlights the importance of obtaining legal advice from a criminal defence lawyer who fearlessly advocates for clients. Rather than taking the easier path without fully analysing and challenging the prosecution's case.
