Dubai Land Department (DLD) issues ‘fractional property ownership,' with the aim of attracting investors which could dramatically add to the investor base in the local real estate market. In its simplest form, fractional ownership allows multiple investors to acquire an apartment, villa or other property types, and with each of them having ownership rights through the title deeds.

Under the current rules, “maximum of four investors can acquire property together in the emirate,” A fractional title deed effectively divides what would normally be one unit (held via a single deed) into two or four parts. The fractional ownership rules apply to existing as well as older projects as long as they are approved by RERA and Dubai Land Department in meeting necessary requirements.

The move to open up fractional ownership allows the authorities and developers to target much wider base of investors.

Fractional ownership is quite the path-breaker for Dubai real estate. Until now, individual investors had to buy a unit in full. There could be other investors, but only one gets to have the title deed under his/her name. If one of the fractional title deed owners want to exit, he/she can just sell his/her stake and transfer the deed to another buyer. The processes are smooth enough.

Why Indoor Air Quality is so important while choosing a property?

Fresh, clean air is a precious commodity. When it comes to living in apartments, indoor air quality becomes a big challenge because many of the pollution sources, such as the interior building materials, furnishings, finishes, textures, appliances, are similar.

So it is important to make sure that the air quality in your building is fresh, clean, and safe. In almost all cases, we cannot choose our neighbors. However, we can be a good neighbor by not using some products that can decrease the quality of your indoor air.

The categories like combustible contaminants, volatile organic compounds, and asthma/allergy pollutants are major factors. Combustible pollutants like nitrogen dioxide and carbon monoxide that come from stoves, water heaters, space heaters, dryers, and fireplaces which are not adequately vented and can cause issues in your apartment or condo. Volatile organic compounds are organic chemicals like acetone, ethylene, and formaldehyde that are released as gases from solids or liquids. You can typically find them in varnishes, paints, cleaning supplies, pesticides, and glues. However, some VOCs are found in makeup products and air fresheners, too. Asthma and allergy triggers can include dust mites, mold, pollen, smoke, and pet dander. Mold can be found on soft textiles like pillows, and you can be exposed to pet dander if you have dogs, cats.

So, one of the key to a successful project is Air Quality. Choose a project or developer who understands the quality of living by implementing strategies that assure good ventilation, use of good quality materials, textures, appliances, proper maintenance and adequate monitoring methods.

Personally you can look out for air quality monitors that give accurate readings of pollutants in the air, monitor humidity level constantly, replace Air Filters frequently, keep you place clean.

Real estate Sale Purchase Agreement(SPA) is a legal contract between a buyer and seller. It is a most commonly used term in real estate transactions. Once buyer and seller agree to buy or sell a specific unit, they enter into a Sale and Purchase Agreement commonly known as SPA in UAE.

Review Developer’s license
Buyers should review the developer's permits and verify that the developer is registered with the Dubai Land Department.

Find whether the project is registered
In Dubai, every real estate project is registered with either the Land Department or through OQOOD as authorized by the Real Estate Regulatory Department of Dubai (RERA).

Request a copy of Title Deed
It is very important to examine the title deed. It is relevant for the purchaser to check if the owner of the property, as what is mentioned in the title deed is referenced in the SPA. Along with checking the title deed, the purchaser should inspect the rights granted to the owner of the property and check if there are any limitations.

Review the details in SPA
To expedite the process, buyers frequently overlook checking the parties involved in the contract, as there may be multiple parties to the contract, such as the owner, developer, manager, and others. Therefore SPA must be thoroughly examined, and due diligence on the seller is essential.

Check the Payment Schedule
In a general, the developer's payment plan terms may be excessively long for a specific property. Therefore, it is important to review the schedule as they represent the buyer's only responsibility under the contract and should be carefully examined to see if it meets the Developer's construction phases.

The completion date
Each SPA has a completion date on which the owner will hand over the unit to the buyer. It is important to understand the completion date and its terms.

Review Termination & Dispute Clauses
In a general termination clause, the owner / developer retains the initial investment amount paid by the buyer in the event of termination of the agreement or if the buyer fails to abide by his financial obligations. Buyer must carefully study the governing law to ensure if the law regulating the contract is of UAE.
