The Government of the United Arab Emirates has introduced Federal Decree-Law No. (9) of 2024, which amends specific provisions of Federal Decree-Law No. (33) of 2021 regarding the regulation of Employment Relationship Law, specifically substituting Articles (54) and (60).
The amends denotes the following;
1- The ministry shall take jurisdiction over claims does not exceed 50,000 Dhs in its amount.
2- The right to appeal is granted within a limitation period of 15 days.
3- In such case, appeal shall be before the court of first instance, and the verdict issued accordingly is final.
4- Through the Decree, the minister is granted discretionary powers, to intervene and impose measurements, whenever public interest is threatened.
5- The decree stipulates for two years limitation period for the claims of concern.
6- A fine of no less than 100,000 DHS and does not exceed 1,000,000 Dhs, is imposed upon;
A. Employing a worker who is not permitted to work for him;
B. Recruiting or employing a worker and leaving him without work;
C. Using work permits for purposes other than those for which they were issued;
D. Closing an establishment or suspending its activity without taking actions for settling the workers’ rights in violation of the provisions of this Decree-Law, its Implementing Regulation and the resolutions issued for its implementation;
E. Employing a juvenile in violation of the provisions hereof;
f. permitting to employ a juvenile.
7- circumventing the laws to obtain personal benefits.
8- Similar cases, may be settled in exchange of 50% pay of the minimum fine set for the offence, in addition to the reimbursement of all financial incentives gained as a result.
