غرامة 100 ألف درهم وسجن لمدة عام بسبب مراجعات "خاطئة" على وسائل التواصل الاجتماعي في الإمارات العربية المتحدة.

This new federal decree-law for non-Muslims in the UAE — which will come into effect in February 2023 — is "a progressive step in the country's legal system"

This new Federal Personal Status Law of seven pages covers marriage, divorce, and inheritance of non-Muslim nationals and expats residing in the UAE. This will regulate marriage conditions and the procedures at the courts and specify the divorce processes that can be initiated jointly or unilaterally.

The new decree-law also organises the procedures for settling the financial claims after divorce, and the arrangement of joint custody for the children. Moreover, the decree-law puts in place the procedures for inheritance and testaments (wills) and proofs of paternity.

بدأ مجلس تنافسية الكوادر الإماراتية (نافس) تطبيق قرار مجلس الوزراء رقم 95 لسنة 2022 في شأن المخالفات والجزاءات الإدارية المرتبطة بمبادرات وبرامج «نافس»، والذي أناط بالوزارة والمجلس تطبيق الجزاءات الإدارية وفقاً للاختصاص.

وحدد القرار مجموعة جزاءات وغرامات إدارية تختلف حسب طبيعة المخالفة التي ترتكبها المنشأة والمرتبطة بمبادرات وبرامج مجلس تنافسية الكوادر الإماراتية (نافس)، مثل التحايل للحصول على هذه الامتيازات أو الالتفاف على مطلب تحقيق مستهدفات التوطين، لاسيما عبر التوطين الصوري، أو ما يتعلق بالبرامج ذات الصلة بالتدريب والتطوير، حيث تشمل الغرامات المالية والجزاءات الإدارية وقف الدعم، واسترداد المبالغ التي صُرفت للشركة المخالفة، وإجراءات أخرى قد تصل الى الإحالة للسلطات القضائية في حال ثبت التحايل بصورة واضحة.

ونص القرار في حالة التوطين الصوري على غرامة مالية لا تقل عن 20 ألفاً ولا تزيد على 100 ألف درهم على المنشأة عن كل موظف مواطن، بينما يكون الجزاء المطبق على المستفيد وقف الدعم واسترداد المبالغ التي صُرفت.
